Uncertainty Over Swapna Barman’s Candidature as Disciplinary Row with Railways Continues
The electoral prospects of Swapna Barman have come under a cloud following a disciplinary dispute with her employer, the Railways. Barman, an Asian Games gold medallist and recent entrant into the All India Trinamool Congress, has been named as a candidate from the Rajganj Assembly constituency in West Bengal’s Jalpaiguri district.
Key Highlights
- Swapna Barman faces a departmental inquiry by the Railways
- Court directs her to admit misconduct linked to service rule violations
- Resignation submitted but not accepted due to ongoing proceedings
- Clearance certificate required to contest elections remains pending
- Final decision on candidature depends on compliance with court orders
Dispute Over Service Rules
The issue stems from Barman’s entry into active politics while still employed with the Railways. She joined the Trinamool Congress on February 27 and was later announced as a candidate without formally resigning from her government position.
The Railways initiated a departmental inquiry on March 9, citing violation of service rules that restrict employees from engaging in political activities without prior approval or resignation.
Legal Proceedings and Court Directions
The matter reached the Jalpaiguri Circuit Bench of the Calcutta High Court, where it was heard by Justice Gourang Kanth.
During the hearing, the Railways informed the court that it could not issue the mandatory clearance certificate required for contesting elections while disciplinary proceedings were ongoing. The agency also indicated that clearance could be considered if Barman formally admitted misconduct and waived certain service-related claims.
The court subsequently directed Barman to submit a written admission of misconduct. While she submitted a letter, it was reportedly deemed insufficient by the Railways, prompting the court to ask for a revised submission.
Official Position
Legal representatives for the Railways maintained that rules governing government employees must be followed strictly. They reiterated that ongoing disciplinary proceedings prevent acceptance of her resignation and issuance of clearance at this stage.
Barman’s legal response has focused on resolving the issue through court intervention.
Context and Background
Government employees in India, including those in the Railways, are bound by conduct rules that prohibit participation in political activities without prior resignation or permission. These rules are designed to maintain administrative neutrality.
Swapna Barman gained national recognition after winning a gold medal in the heptathlon at the 2018 Asian Games, and later took up a role as a Social Welfare Officer in the Railways.
Public Impact
The case highlights the procedural and legal requirements that public servants must meet before entering electoral politics. It also underscores the role of service rules in maintaining institutional integrity.
For voters in the Rajganj constituency, the uncertainty may affect candidate clarity ahead of the elections.
The future of Barman’s candidature now depends on her compliance with the court’s directives and the outcome of the Railways’ disciplinary process. Further hearings and administrative decisions are expected to determine whether she will be eligible to contest the upcoming Assembly elections.
